课程目标
本课程旨在帮助学员了解美国复杂的宪法结构如何塑造美国经济并与学员一同剖析美国政
府机构的运作。
美国宪法发源于普通法和自然法的传统法律规范，并将之与现代科学观念相调和。因此，
美国宪法结构结合了自然公正原则和现实的经济利己主义。本课程将考察宪法如何利用这
些对立的力量倾向来构建美国庞大的商业共和国。在这个商业共和国中，为要促进经济，
同时限制任一的经济或政治团体权力独大 ，宪法机制起了使经济利益多样化的作用。本课
程旨在使学员更好地理解在现实中，美国政府如何不完美的交织着自然法与实证法的概念
，形成今日的美国经济以及它的宪法秩序。

Non-U.S. law students;

eper understanding of the U.S. legal-political system.
Legal students from China, Hong Kong, Taiwan, Singapore, Japan, Thailand, Viet
nam, Malaysia, Indonesia, and South Korea are encouraged to apply for this two
