方舟子在访谈中说过,他的生活费的一部分得益于他依据博士论文申请的专利,获得了一
笔钱。
因此有人认为这是造假:
1. 专利的发明人中方舟子排名第四,应该权利不多
2. 专利权属于美国一个研究院,方舟子已经卖掉了
3. 就这一个专利卖不了多少钱。
1. 首先我们看下方舟子的专利,发明人的确是四个,请注意,专利的发明人的排序没有任
何意义,这个和论文不同,四个人有完全平等的权利。
2. 美国的专利法先前是先发明制,而且只能是发明人申请,然后转让给公司或者其他单位
,可以获得一笔转让费,这个和中国不同,在中国单位是可以直接申请专利的,个人只是
发明人而已,单位给点奖励。
3. 首先注意专利不仅可以在一个国家申请,还可以在N个国家申请,比如方舟子这个专利
申请了PCT,欧洲专利,日本专利,澳大利亚专利,加拿大专利等,请看附录
4. 专利并不一定非要直接用在产品上才能值钱,对于产品布局中无法绕过的专利,尽管没
有直接用在产品上,但产品落在该专利的权利要求范围中,就能需要支付专利费
5.生物专利往往价值较大, 伟哥的专利价值数十亿美元
另外呼吁大家在写论文时,一定要注意专利保护的意识,在申请专利之前不要轻易发表论
文,专利申请后一般有一年到一年半的保密期,不对外公布,大家要是论文写好了,先申
请专利,然后发表论文,并不影响,对于可能有商业应用的论文一定要先申请专利,否则
就是白白贡献给社会。
